FDA Replaces QSR with QMSR: What ISO 13485:2016 Means for U.S. Medical Device Companies

The U.S. Food and Drug Administration (FDA) has finalized one of the most significant updates to medical device quality regulation in decades. The long-standing Quality System Regulation (QSR), codified at 21 CFR Part 820, has been replaced by the new Quality Management System Regulation (QMSR).

At the heart of this change is the FDA’s decision to incorporate by reference ISO 13485:2016, the internationally recognized quality management system standard for medical devices.

What does “incorporation by reference” mean?

Incorporation by reference means that ISO 13485:2016 is now legally enforceable as part of U.S. federal regulation. Instead of rewriting the full ISO standard into U.S. law, the FDA has adopted it directly as the core quality system framework under QMSR.

In practical terms, ISO 13485 is no longer just a “best practice” or certification standard — it is now the foundation of FDA quality system compliance.

Why did the FDA make this change?

The FDA’s goals include:

  • Harmonizing U.S. requirements with global regulatory systems

  • Reducing duplication for companies operating internationally

  • Modernizing inspections to focus on risk-based, system-level performance

This alignment brings the U.S. closer to other major regulatory authorities such as the EU, Canada, and Australia, all of which already rely on ISO 13485.

What changes for manufacturers?

While the structure of ISO 13485 will feel familiar to many organizations, the FDA retains authority to enforce:

  • U.S.-specific statutory requirements

  • Complaint handling and record retention expectations

  • Inspection and enforcement processes under FDA law

ISO 13485 certification alone does not guarantee FDA compliance. Companies must ensure that their quality management systems address both ISO requirements and FDA-specific obligations.

Timeline and enforcement

The final rule was published in January 2024, with a transition period allowing industry to prepare. Full enforcement of QMSR begins on February 2, 2026.
